Terms of Service

1. The service

Toast Album, ABN 60 422 621 849 provides Toast Album, a service that lets event hosts collect photos from guests via a QR code into a private gallery. These terms apply to hosts who create an account and to guests who upload or view photos.

2. Accounts

Hosts must provide accurate details and keep their login credentials secure. You are responsible for activity under your account, including the sharing of your event's private links and passcode.

3. Plans and payments

Each account gets one free event, on the free plan with its published photo limit, storage limit, and retention period. Later events open to guests once a paid plan is bought. Paid plans are one-time purchases per event, processed by Stripe, and apply once payment is confirmed. Prices are listed in AUD on the pricing page.

Upgrades, refunds and cancellations. Upgrading an event to a larger plan costs only the difference between the two plans' prices. You can't move an event to a smaller plan for a partial refund. We'll refund a plan or upgrade in full if you ask before any photo is uploaded to the event and while the event still exists. A refunded upgrade returns the event to its earlier plan. Otherwise your account's free event goes back to the Free plan, and any other event closes to guests until a plan is bought for it again. After photos arrive there are no change-of-mind refunds. If Toast Album doesn't work for your event because of a problem on our side, we will fix it or refund you. Deleting a paid event doesn't refund it automatically, so if you want a refund, ask us before you delete. To ask for a refund, email support@toastalbum.com.au. Nothing in these terms excludes rights you have under the Australian Consumer Law.

4. Your content

You and your guests keep ownership of uploaded photos. You grant us only the licence needed to store, display, and deliver them within the event's private gallery and downloads. We never use event photos for advertising or AI training.

5. Acceptable use

Don't upload unlawful, infringing, or abusive material; don't attempt to access other events, bypass passcodes or payment, or disrupt the service. Hosts can remove any guest upload from their event, and we may remove content or suspend accounts that break these rules.

6. Host responsibilities

Hosts confirm they have the right to collect photos at their event and are responsible for letting guests know uploads are shared into the event gallery, and for who they share the event link and passcode with.

7. Storage and availability

Every plan's gallery period starts on your event date: Free has a 60-day gallery; Classic and Signature have a 1-year gallery; Large Event galleries are agreed with you. Guests can upload only while your event's upload window is open. When the gallery period ends, the gallery closes to guests and you can still download your photos for a further 30 days. The photos are then permanently deleted, and any backup copies within 35 days after that. We'll also email you reminders 14 days and 3 days before your photos are deleted. We take care with your media, including secure private storage, but you should download your archive after the event. The service is provided "as is" to the extent permitted by law.

8. Liability

To the maximum extent permitted by law, our total liability for any claim relating to the service is limited to the amount you paid for the affected event. Nothing in these terms limits liability that cannot be excluded under applicable law.

9. Ending an event or account

You can delete an event that was never paid for straight away from its Manage page. A paid or refunded event you delete there closes to guests straight away and is deleted, with all its photos, 7 days later, so you can cancel until then; payment records are kept for accounting. Once you have no events left, you can delete your account from Account settings. To ask us to delete personal information, email privacy@toastalbum.com.au.

10. Changes to these terms

We may update these terms. Material changes will be shown on this page with a new date. A change never applies to an event you've already paid for: that event keeps the terms in place when you paid. Using Toast Album for new events or purchases after a change means you accept the updated terms.
